1. Scope
These General Terms and Conditions (GTC) apply to all business relationships between you and Andreas Clemens, Gotenstrasse 81, 10829 Berlin (hereinafter referred to as “Provider”), which are conducted via the website www.rico.berlin (hereinafter referred to as “Website”). The version of these GTC that is valid at the time of the conclusion of the contract is authoritative.
2. Contractual Partner
The purchase contract is concluded with Andreas Clemens, Gotenstrasse 81, 10829 Berlin.
3. Conclusion of Contract
The presentation of products on our Website does not constitute a legally binding offer but rather a non-binding online catalog. By clicking the “Buy” button, you place a binding order for the items in your shopping cart. Confirmation of receipt of your order is sent by automated email immediately after the order is placed and does not constitute acceptance of the contract. The contract is only concluded when we send you an order confirmation or deliver the goods within two days.
4. Prices and Payment
All prices listed on the Website are inclusive of statutory VAT and other price components. Additional shipping costs are indicated separately during the order process. You can choose from various payment methods, including credit card, PayPal, and bank transfer. The Provider reserves the right to exclude certain payment methods in individual cases.
5. Delivery Conditions
Delivery is only made to addresses within Germany unless otherwise agreed. Delivery times indicated on the product page are approximate and non-binding. If not all ordered products are in stock, we are entitled to make partial deliveries at our expense, provided this is reasonable for you. Should the delivery of the goods fail due to your fault despite three attempts, we can withdraw from the contract. Any payments made will be refunded immediately.
6. Retention of Title
The goods remain our property until full payment is made. Prior to the transfer of ownership, pledging, transferring by way of security, processing, or transformation is not permitted without our consent.
7. Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (Andreas Clemens, Gotenstrasse 81, 10829 Berlin, contact@rico.berlin) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Since we offer subscription-based digital services, there are no physical goods to return. Therefore, the conditions related to the return of goods and any associated costs do not apply.
You are only liable for any diminished value of the digital service resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the service.
8. Warranty and Guarantees
Unless expressly agreed otherwise, your statutory warranty rights apply. Since we offer subscription-based digital services, there are no physical items to deliver, and therefore, no material or manufacturing defects or transport damages can occur. If you experience any issues with our digital service, please report them to us immediately at contact@rico.berlin. We are committed to resolving any service-related issues promptly. Failure to report issues does not affect your statutory rights.
9. Liability
We are liable without limitation for intent and gross negligence. In the event of slight negligence, we are liable only for breaches of essential contractual obligations (cardinal obligations), the violation of which jeopardizes the achievement of the purpose of the contract, or for damages resulting from injury to life, body, or health. In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to foreseeable, contractually typical damages.
10. Data Protection
We collect, process, and use your personal data only in accordance with our Privacy Policy and the relevant data protection laws, specifically the General Data Protection Regulation (GDPR) of the European Union.
11. Final Provisions
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. Instead of the invalid provision, the relevant statutory provisions shall apply.
12. Subscription Confirmation and Reimbursement
We strive to confirm your subscription immediately upon purchase. If we are unable to confirm your subscription, we will notify you promptly and reimburse all payments received from you without undue delay, and in any event, no later than fourteen (14) days from the day we are informed of your decision to withdraw from the contract. The reimbursement will be processed using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
